The directive 2002/95/CE of the European Parliament restricts the use of six hazardous substances in electrical and electronic equipment such as Lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls or polybrominated diphenyl ethers.
This is a “single market” policy involving all member states so it should be implemented in the same way in all of them to avoid bureaucratic barriers.

On February 25, 2005, The Spanish Ministry of Environment adopted Royal Decree 208/2005, concerning the management of discarded electric and electronic products. It translates into national legislation Directive 2002/96/EC, as amended by Directive 2003/108/EC on waste electrical and electronic equipment (WEEE) to reduce their disposal and the danger of some of the components as well as regulating their management to improve environmental protection.

El RD 208/2005, de 25 de Febrero, sobre aparatos eléctricos y electrónicos y la gestión de sus residuos, recoge las Directivas Europeas 2002/95 CE sobre restricciones a la utilización de determinadas sustancias peligrosas en aparatos eléctricos y electrónicos (RoHS); 2002/96/CE, sobre residuos de aparatos eléctricos y electrónicos; y 2003/108/CE sobre establecer medidas para prevenir la generación de residuos procedentes de aparatos eléctricos y electrónicos y reducir su eliminación y la peligrosidad de sus componentes, así como regular su gestión para mejorar la protección del medio ambiente.
